Do You Need To Enforce An Existing Child Support Order?
Child custody and support are often the most disputed areas in divorce negotiations, because they affect both emotions and money. Sometimes, a noncustodial parent will refuse to pay support because the other parent is refusing to let him or her see the children.
Under California law, however, the two matters are separate. The noncustodial parent must pay child support, regardless of whether the custodial parent adheres to the parenting plan or not. Likewise, failure to pay child support is not a valid reason for refusing to allow the other parent to spend time with the children.
